ACT-CIS Representative Erwin Tulfo is facing a new challenge to his senatorial candidacy, with a 28-page petition filed by Berteni Causing alleging multiple grounds for disqualification.
The petition centers on Tulfo’s 2008 libel conviction, questions surrounding his citizenship, and accusations of violating anti-dynasty laws. While yet to receive a copy of the petition, Tulfo has publicly stated his intention to file a comprehensive response, expressing respect for the Comelec’s process.
Causing’s petition argues that Tulfo’s 2008 conviction for four counts of libel constitutes moral turpitude, leading to disqualification under the Omnibus Election Code (OEC). The petition meticulously calculates a disqualification period extending to 2028, based on a five-year disqualification for each libel count served consecutively.
Further allegations question Tulfo’s Filipino citizenship, citing evidence of a US passport and his oath as a US Army member. The petition contends that his failure to renounce his US citizenship renders him ineligible for public office in the Philippines. Additionally, Causing alleges a violation of anti-dynasty laws due to Tulfo’s candidacy alongside his brother, Senator Raffy Tulfo.
Comelec Chairperson George Erwin Garcia has confirmed the petition’s receipt and indicated a decision on whether to proceed or dismiss the case is expected by March 3rd. The possibility of defects in the petition remains, potentially leading to its dismissal.
Despite the serious nature of the allegations, Tulfo’s commitment to respond directly addresses the challenges to his candidacy.

“Ngunit bilang bahagi ng proseso ng hustisya na umiiral sa ating bansa ay nakahanda po akong sagutin itong kaso na isinampa ni Causing, na isang abogadong tinanggalan ng Korte Suprema ng lisensiya at idineklara ng Comelec na panggulo lang, o nuisance candidate, sa darating na 2025 senatorial election. Iginagalang ko po ang kanyang karapatang magsampa ng reklamo at ipinauubaya ko sa Comelec ang paghusga,” Tulfo said.
