Ombudsman: Senate refuses to receive subpoena for CCTV

OMBUDSMAN Jesus Crispin “Boying” Remulla disclosed that the Senate allegedly declined to accept an official subpoena requesting access to security camera footage and other relevant documents related to the tense standoff that unfolded within the Senate building last Wednesday.

The directive was issued as part of the formal investigation into the incident, which involved a confrontation between security personnel and National Bureau of Investigation agents and which preceded the sudden departure of Senator Ronald “Bato” dela Rosa amid an outstanding international arrest warrant. Remulla noted that despite the refusal to take delivery, the upper chamber had been properly informed of the requirement to produce the materials.

Remulla emphasized that under procedural rules, the subpoena is already “considered served” and legally effective even if Senate officials or staff chose not to formally receive or acknowledge it.

This means the institution is now legally bound to comply and submit the requested evidence within the prescribed period, regardless of whether they accepted the physical document. The Ombudsman clarified that the move is necessary to establish a clear, accurate timeline of events, identify those responsible for security lapses or possible obstruction, and determine whether public officials acted within the bounds of the law during the highly controversial incident.

The refusal to receive the subpoena adds another layer of conflict between the executive branch and the legislature, coming at a time when the Senate is already under intense public scrutiny over issues of accountability and transparency.

The requested CCTV footage and official records are viewed as critical evidence, especially following reports that some lawmakers attempted to influence or restrict access to such materials. Remulla warned that failure to comply with a deemed‑served subpoena carries serious legal consequences, and assured the public that the investigation will proceed unhampered to uncover the full truth behind the chaotic events that have raised serious questions about the rule of law in the country.
