THE Supreme Court (SC) has issued guidelines for the transfer and assumption of jurisdiction regarding cases and crimes within Parcels 3 and 4, PSU-2031 of the Fort Bonifacio Military Reservation acknowledged as part of Taguig City.
Responding to a request from Taguig City Mayor Maria Laarni L. Cayetano, the SC has approved the transfer of jurisdiction to Taguig City courts, effective January 1, 2024, despite the initial proposed date of October 16, 2023.
To allow for adequate preparation by the courts, prosecution, Public Attorneys Office, and other court users, the SC has postponed the effective date for the transfer, according to a report on abogado.ph
Therefore, from January 1, 2024, onwards, all civil and criminal cases arising in the affected areas are to be filed in the courts of Taguig City.
Criminal complaints related to incidents before this date will be directed to the Makati City Prosecutor’s Office, while those occurring on or after January 1, 2024, will be under the jurisdiction of the Taguig City Prosecutor’s Office.
Pending civil and criminal cases before the first- and second-level courts in Makati City before January 1, 2024, will continue their proceedings, with trials, hearings, and decisions to be handled by the respective Makati City courts.
All parties, including judges, court personnel, prosecutors, public attorneys, legal practitioners, and the general public, are urged to review and comply with the guidelines for a seamless and organized transition.
