THE Pasay Regional Trial Court (RTC) has directed the Senate to respond within 72 hours to a Writ of Amparo filed on behalf of Brice Hernandez, a former engineer from the Department of Public Works and Highways (DPWH).
The order, issued by Branch 112 of the Pasay RTC on Sept. 11, 2025, demands that the Senate provide a verified written return to the court, detailing its lawful defenses and outlining the measures taken to protect Hernandez’s constitutional rights to life, liberty, and security.
The petition, filed by Hernandez’s wife, Rica Fausta Abacan-Hernandez, claims that the Senate’s actions or omissions have violated or threatened her husband’s fundamental rights.
The court mandates the Senate to submit all pertinent information regarding the alleged threats against Hernandez. Failure to comply with the 72-hour directive may result in sanctions under the Rule on the Writ of Amparo. The Senate is required to file its response with the Pasay RTC branch.
