THE Supreme Court (SC) has reaffirmed the immediate enforceability of its July 25 decision, which declared the impeachment complaint against Vice President Sara Duterte unconstitutional.
In a statement released Tuesday, the High Court emphasized that the decision to dismiss the fourth impeachment complaint was unanimous among the Justices present. The SC reiterated that the impeachment complaint was deemed void due to violations of the one-year ban rule and due process requirements.
The Court acknowledged receipt of a motion for reconsideration filed by the House of Representatives and has directed Vice President Duterte and her legal counsel to respond within a non-extendible period of 10 days.
A motion for reconsideration filed by Akbayan party-list Rep. Percival Cendaña and others was also noted, with the SC’s action on their motion for intervention still pending. The Supreme Court’s firm stance underscores the finality of its decision and signals a potential constitutional clash between the judiciary and the legislative branches.
