Malacanang: Marcos clears BIR to release VP Sara, Carpio tax records for trial

MALACANANG confirmed on Thursday that President Ferdinand “Bongbong” Marcos Jr. has granted official clearance to the Bureau of Internal Revenue (BIR) to open and turn over the tax records of Vice President Sara Duterte and her husband, lawyer Manases “Mans” Carpio.

Palace Press Officer Undersecretary Claire Castro made the confirmation during a press briefing, confirming that the President gave the necessary approval after the BIR submitted the documents to the Senate impeachment court. “The reporter was asking whether the President has already approved or granted clearance to the BIR to open the tax records of VP Sara and Atty. Mans Carpio? Yes,” Castro stated clearly.

The authority to release such records falls under Section 71 of the National Internal Revenue Code, which provides that tax returns may be opened for inspection only upon the order of the President.

Castro explained that the submission of the documents to the Senate effectively places the use of these records within the discretion of the impeachment court for the duration of the proceedings. She added that the President acted strictly in accordance with law and out of commitment to the truth: “If it is stated and required that he give his approval to the BIR to open their tax records, and this is for the sake of truth, he will not withhold the truth from our countrymen.”

The move comes a week after the impeachment court began issuing subpoenas to the BIR, the Anti‑Money Laundering Council, and various banks to produce financial records relevant to the case.

When asked for reaction, defense spokesperson Atty. Michael Poa said he has no comment at this time. Castro acknowledged that the President’s action could set a precedent for future administrations, but emphasized that the decision was driven by legal obligation and the pursuit of facts rather than political consideration.

Addressing possible criticism that the clearance is politically motivated, Castro noted that accusations often arise whenever public officials act within the law but affect certain parties. “Whenever the President acts in accordance with the law but someone is affected, they will always say it is politically motivated. Where then should the President turn?” she said. The Palace maintained that the administration remains guided solely by due process, transparency, and the rule of law as the impeachment trial moves forward.
