DOJ recommends 44 tax evasion cases vs BGC Boys over P1.68B liabilities

THE Department of Justice (DOJ) has recommended the filing of 44 criminal tax cases against the so‑called “BBC Boys” or the “Bulacan Group of Contractors,” who face a combined tax liability amounting to ₱1.68 billion, the Bureau of Internal Revenue (BIR) announced. The recommendation follows a thorough review by the DOJ, which found sufficient legal basis to pursue charges against the group.

According to the BIR, separate resolutions from the DOJ determined that there is probable cause to prosecute Jaypee De Leon Mendoza, Henry Alcantara, and Brice Ericsson Hernandez Mabini. The cases stem from their alleged failure to properly declare and report their income over several years. Investigations revealed significant discrepancies between the earnings they declared and their actual lifestyle and expenditures, prompting the BIR to conduct a lifestyle check that confirmed inconsistencies.

The three individuals are being charged for violations of Sections 254 and 255 of the National Internal Revenue Code. The BIR’s findings showed they engaged in underdeclaration of income, non‑filing of required tax returns, and underreporting of earnings across different taxable periods. The discrepancies between their reported income and actual spending were found to be substantial and unexplained.

Breakdown of the cases shows Mendoza faces 16 counts covering taxable years 2021 to 2024, with liabilities totaling ₱179.79 million. Alcantara will face 18 cases for 2022 to 2024, amounting to approximately ₱913.83 million, while Hernandez is recommended for 10 cases from 2020 to 2024 with a liability of ₱593.78 million.

The filing of these cases is part of the BIR’s intensified campaign against tax evasion, particularly targeting high‑profile individuals believed to be evading their tax obligations. As of the latest update, Hernandez and Mendoza are currently detained at the New Quezon City Jail, while Alcantara has been placed under the government’s Witness Protection Program.
