Contractor Discaya files petition questioning Senate detention

CONTRACTOR Pacifico “Curlee” Discaya has filed a petition for certiorari with a court in Pasay City to challenge his ongoing detention by the Senate, according to his lawyer, Cornelio Samaniego III.

Discaya has been detained since September 23, 2025, after being declared in contempt by the Senate Blue Ribbon Committee for allegedly lying about the whereabouts of his wife, Sarah Discaya, during a hearing regarding anomalies in flood control projects.

Samaniego stated that they initially filed a petition for habeas corpus, but the court advised them to instead file a petition for certiorari.

A petition for certiorari aims to correct errors in jurisdiction or grave abuse of discretion by a lower authority.

According to Samaniego, individuals with contempt orders should be released once the Senate hearings conclude.

He emphasized that Discaya and others, including Sarah Discaya and Maria Roma Angeline Rimando, have no intention of evading authorities and have been attending all hearings at the Senate, Lower House, Independent Commission for Infrastructure, and Department of Justice.

The Discayas are under investigation because their construction firms, including Alpha and Omega General Contractor & Development Corporation, have been linked to alleged anomalies in the country’s flood control projects, reportedly securing 20% of the projects under the administration of President Ferdinand Marcos Jr.
