THE Commission on Elections (Comelec) has cleared Senator Rodante Marcoleta of any election offense related to his campaign contributions during the 2022 national elections.
The poll body’s First Division dismissed the complaint filed against the lawmaker, stating that the evidence presented did not sufficiently prove any violation of election laws concerning the reporting and utilization of campaign funds.
The complaint, which alleged that Marcoleta failed to properly declare or accurately report certain campaign contributions, was deemed lacking in merit by the Comelec. Commissioners, in their resolution, pointed to the documents and explanations provided by Marcoleta’s camp, which they found to be satisfactory in illustrating the flow of funds during his campaign. The ruling underscored that the complainants failed to meet the standard of proof necessary for such offenses.
This decision by the Comelec provides significant relief to Marcoleta, allowing him to continue his public service without the cloud of an election offense. The ruling reinforces the importance of due process and the need for substantial evidence when adjudicating cases involving campaign finance regulations, which are often complex and subject to interpretation.
The Comelec’s dismissal of the case signifies that, based on the presented evidence, Marcoleta’s actions regarding his campaign contributions were found to be in compliance with existing election laws and regulations. This outcome allows the focus to remain on legislative duties rather than protracted legal battles over campaign finance disclosures.
