KINANSELA ng Intellectual Property Office (IPO) of the Philippines ang trademark registration ng Television and Production Exponents, Inc. (TAPE) para sa pangalang “Eat Bulaga” at “EB.”
Sa 16-pahinang desisyon na inilabas ngayong Martes, pinaboran ng IPO sina Tito Sotto, Vic Sotto, at Joey de Leon, kilala bilang TVJ, bilang karapat-dapat na may-ari ng “Eat Bulaga” trademark matapos maipaliwanag kung paano at saan nagmula ang pinagmulan ng pangalan ng show.
“It is not the application or the registration that confers ownership of a mark, but it is ownership of the mark that confers the right to registration,” sabi ng IPO.
Samantala, sinabi ng legal counsel ng TAPE Inc. na si Atty. Maggie Garduque na hindi pa nila natatanggap ang kopya ng desisyon. “But if this is true, under the rules [TAPE] can appeal this decision to the director of the [Bureau of Legal Affairs] of IPO,” sabi ni Garduque.
“If still unsatisfied with the decision of the director, they can still appeal it to the director general of the IPO,” dagdag pa nito.
“[TAPE] will avail of all legal actions/remedies to reverse this decision,” ayon pa kay Garduque.
