CHR to probe alleged cases of police abuses in Regions 9, 10

THE Commission on Human Rights (CHR) in Region IX and XI are undertaking a motu propio investigation into the recent separate alleged cases of police abuses.

In the municipality of Don Marcelino in Davao Occidental, a 16-year old minor was allegedly maltreated by three police officers when he went to a police station to report about the physical abuse he suffered in the hands of his father.

Instead of getting the help he needed, the three officers on duty allegedly took the victim into a dark room, poured a solution of vinegar and chili on his private area, and reportedly threatened the victim to keep silent about the incident.

In Zamboanga City, a waiter died while being escorted by three officers of the Zamboanga City police. Prior to being tackled by police officers, the waiter reportedly had a heated argument that escalated into a fistfight with a retired police major at a bar. The waiter allegedly declined to serve beer to the retired police major who was a stroke survivor and was advised against drinking by his fellow retired officer and his son.

CHR welcomes the action of the Police Regional Office XI to file criminal and administrative charges against the three police officers who allegedly committed cruel acts to a minor in Davao Occidental. Similarly, we acknowledge the investigation being done by the Philippine National Police Regional Internal Affairs Service on the death of the waiter in Zamboanga City.

The Commission expresses grave concern on these reported incidents of alleged police abuse and cruelty. As duty-bearers who must “serve and protect” the people, including vulnerable individuals, such as minors and service workers, it is expected that police officers exercise their authority in accordance with the rules and standards required of public officers. Respecting the rights and dignity of individuals is a basic requirement in the conduct of their duty.

In observance of the International Day in Support of Victims of Torture on 26 June 2023, it is crucial that we seriously address any allegation of police abuse and torture to ensure justice and deter future cases of abuse of authority. In accordance with the Anti-Torture Act of 2009 and the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, we continue to firmly remind that no circumstance or context can justify police brutality and/or abuse that equate to torture, inhuman, or degrading treatment or punishment.
